At Earth Funeral Group, Inc. (“Earth,” “we,” “our,” and/or “us”) we seek to provide you with the best possible service.

We’ve drafted this privacy policy to help you understand how we use and disclose the personal information that we collect through the services Earth provides and through its website, www.earthfuneral.com (the “Site” and/or collectively, the “Services”). By using our Services, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. Beyond the Privacy Policy, your use of our Services is also subject to our Terms of Use (www.earthfuneral.com/terms).Since it is very important to us that you are in control of the information you share with us, we have tried to make our policy as clear as possible. 1. What Information is Collected and How We Collect It

1. Information You Provide. We collect information in several ways. When you use our Site, we collect personal information about you and your loved ones that you affirmatively provide to us, including in the following ways. 
2. Registration and Account Information. When you create an account, we ask you for your first and last name and email address. 
3. Communications. If you contact us directly, we receive information about you or your loved one that you choose to provide. For example, when you request a quote, we ask you for your name, email address, phone number, and zipcode. We may also ask you for your or your loved one’s birth date, weight, medical information, and other information that may be necessary to facilitate our Services depending on your needs. You may also provide your phone number and/or email address in order to be contacted by Earth. We also collect personal information in other ways, such as when you contact us by email, traditional mail, and/or telephone.‍

2. Information Provided by Others.

In some instances, we collect certain user data and other usage information via a third party service provider. Such information will be subject to this Privacy Policy but may also be subject to the third party’s own privacy policies. To facilitate and market our Services, we may receive the following categories of personal data about you from third-parties: financial information, professional and education history, certain demographic information, household characteristics, purchasing tendencies, and other individual preferences and characteristics.

3. Information We Collect When You Use Our  Services

1. Location Information. When you use our Services, we receive your location information. For example, we infer your general location information by using your IP address. 
2. Device Information. We receive information about the device and software you use to access our Services, including IP address, device type, device identifiers, web browser type and version, operating system version.
3. Usage Information. We automatically receive information about your interactions with our Services, like the pages or other content you view, referrer information (the website you visited before coming to our Services), the dates and times of your visits, the searches you conduct, and the products and services you purchase.
4. Obituaries and Notes. As part of our Services, we may provide obituaries on our Site where family members and friends can post heartfelt messages and photos. You must be logged into your Earth account in order to post content on obituaries, to like or “heart” notes, or to subscribe to an obituary’s updates. When you post a note, your first and last name will always be viewable by other users. The content you post to an obituary will be displayed on our Site and will be viewable by other users by default. Other users also have the ability to share your notes online. We are not responsible for the other users’ use of available information, so you should carefully consider whether and what to post or how you identify yourself on the Site.  
5. Reviews. As part of our Services, you have the option to post reviews of our Services, either directly on our Site or through Google Reviews. When you post a review, your first name, last name initial, the county and state where you are located, and date of the review will always be included with your review. By default, your reviews are publicly visible on our Site, and anyone on our Site can view them. If you post a review using a third-party platform, the privacy policies and terms of those platforms govern your use of those platforms. 
6. Call Recordings. To provide and improve our Services, we and third-party service providers on our behalf record inbound and outbound calls.
7. Information from Cookies and Other Tracking Technologies. We and our third-party partners collect information about your activities on our Services using cookies, pixel tags, SDKs, or other tracking technologies. Our third-party partners, such as analytics, advertising, and security partners, may also use these technologies to collect information about your online activities over time and across different services. Cookies are pieces of information placed in the settings of your web browser by a website server to identify your computer when you return to a website. Whenever a site welcomes you and tailors data to your specifications, it is reading a cookie left in your browser and identifying information that you may have registered during previous visits, such as your viewing preferences. The use of cookies is a standard practice among Internet websites and most Internet web browsers may be customized to reject cookies, to only accept or reject cookies by user intervention, or to delete cookies. Please note that some website features may not function properly if all cookies are blocked. Except as noted below, the cookies placed by our Site do not collect any personal information, and are essential to provision of a functional website and/or app, which we have a legitimate interest in providing (these are known as “Necessary Cookies” and include cookies that drive your navigation on one of our Site). Once you leave our Site, these Necessary Cookies are no longer used. When you interact with our Site, we also collect limited non-personally identifying information that the browser you use makes available automatically. This information includes the internet address of the computer or network you used to access our site, the date, time, and page(s) you visited on our site, the browser and operating system you used, and the referring page (the webpage that contained the link to our site that you clicked on to get there).
8. Online Tracking/Do-Not-Track Signals. Except as stated in this Privacy Policy, we do not track your activity across third-party websites. Currently, various Internet browsers offer a “Do-Not-Track” option that uses a header to indicate a Do-Not-Track preference on the browser. Because the providers of Do-Not-Track and similar signals do not yet operate according to common, industry-accepted standards, we currently do not respond to those signals. 9. Payment Information. The safety of your credit card information is important to us, and Earth makes commercially reasonable efforts to help securely process the information you provide. We collect your payment information when you participate in our pre-payment plan. We also use companies specialized in collecting and processing your payment information, including Stripe (“Payment Processors”). If you choose to make a payment, please be aware that these Payment Processors are not affiliated with Earth, but they do adhere to their own privacy policies, which may be found on their respective websites. Please review the relevant privacy policy prior to providing your credit card information.

4. How We Use the Collected Information

We disclose personal information as reasonably necessary to operate our Services, such as in connection with providing requested services to you.

• Analytics Partners. We use analytics services, such as Google Analytics, to collect and process certain analytics data. For more information on collection and processing of data through Google Analytics, please see www.google.com/policies/privacy/partners.
• Other Third Parties. In an ongoing effort to better understand our customers, we receive information from third parties to carry out, maintain, manage, and improve operations in connection with our Services. For example, we may share personal information to facilitate conversion tracking. 
• Merger, Sale, or Other Asset Transfers. We may transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets. The use of your information following any of these events will be governed by the provisions of this Privacy Policy in effect at the time the applicable information was collected.
• Consent. We may also disclose your information with your permission.
• As Required By Law and Similar Disclosures. We may release personal information if we believe in good faith that: the law or legal process requires it; we have received a valid administrative request from a law enforcement agency; or such release is necessary to protect our rights, property, or safety, or that of our respective affiliates, business partners, customers, or others. For the avoidance of doubt, the disclosure of your information may occur if you post any objectionable content on or through the Services.
• Vendors and Service Providers. In some instances, Earth uses third-party vendors and service providers  to process your personal data. Our contracts with these third-party processors require them to comply with the terms and the intent of this Privacy Policy, and to make all commercially reasonable efforts to safeguard your information.
  
• Advertising Partners. We may share your information with key partners and affiliates whose merchandise and services we believe are of interest to you. We have contractual relationships with all such partners and affiliates that require them to safeguard your information and allow you to opt out of receiving further information from them. Some of our advertising partners are members of the Network Advertising Initiative (https://optout.networkadvertising.org) or the Digital Advertising Alliance (https://optout.aboutads.info) and serve ads through cookie-based technologies. Please visit their opt-out pages to learn about how you may opt out of receiving certain web-based personalized ads from member companies. These opt-outs will apply only to our third-party advertising partners that are members of these organizations. These opt-outs will not apply when our partners serve ads through non-cookie based technologies.
• Mobile information. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. Any other mentions in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. If you wish to be removed from receiving future communications, you can opt out by texting STOP.

5. Marketing Messages

If you do not want to receive commercial emails from us in the future, you may opt out by following the unsubscribe instructions contained in the marketing emails you receive.

Please note that even if you request that we no longer send you marketing messages, if you request our services, you will continue to receive administrative messages from, such as emails confirming the service you have chosen. We may also contact you by phone with your consent. We will retain the information you provide in connection with your matter for as long as we have a legitimate interest in maintaining it for administrative purposes.

6. For Oregon Residents: Your Rights

For consumers who are residents of Oregon, you have the following rights with regards to your personal data, as applicable under the Oregon Consumer Privacy Act. 

• Right to Access: You may request access to the personal data that Earth has collected about you through your use of our Services. For example, you have the right to request access to the list of specific third parties to which we have disclosed your personal data. 
• Right to Correct: You have the right to correct inaccurate personal data we have collected about you.
• Right to Delete: You have the right to request that Earth delete the personal data it has collected about you, subject to applicable legal exceptions. 
• Right to Opt Out of Targeted Advertising and Sale of Personal Data: You have the right to opt out of targeted advertising and the sale of your personal data. To opt out of targeted advertising and sale of your personal data, please submit an opt-out request by emailing privacy@earthfuneral.com or calling (877) 327-4109.

7. How We Protect Your Information

We take reasonable and appropriate security measures to protect unauthorized access, alteration or destruction of data located on and collected by our Site. We exercise reasonable care to protect your non-public personal information. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. While we strive to protect your non-public personal information, we cannot guarantee the security of any information you transmit to us or receive from us while it is in transit.

We recommend only using a secure connection in order to transmit information to us. Once we receive your personal information, we maintain physical, electronic, and procedural safeguards to protect it. If a data breach occurs and your personally identifiable information is compromised, we will notify you, the proper authorities, and third-party entities within a reasonable time period, but no more than thirty (30) days from discovery of the breach, subject to law enforcement or internal system security needs.

9. Miscellaneous

• Children’s Access. The Site is a general audience website, intended for adult use. Earth does not market to, and does not knowingly collect any personally identifiable information from children under sixteen (16) years of age. Please contact our customer service department at privacy@earthfuneral.com if you are aware of any personal information supplied to the Site by a child under the age of sixteen (16).
• Third-Party Links. While you are using this Site, you may be linked or directed to other third party sites outside of the Site that are beyond our control. Each of these third party sites may have a privacy policy different from ours. For example, you might click on a link or banner ad that will take you off the Site. These links and banners may take you to sites of advertisers, sponsors and co- branding partners. Please review the privacy policies of these sites. We are not responsible for any actions or policies of such third parties.
• International Visitors. Our Services are hosted in the United States and intended for visitors located within the United States. If you choose to use the Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the U.S. for storage and processing. We may also transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Services. By providing any information, including personal information, on or to the Services, you consent to such transfer, storage, and processing.
• Changes to the Privacy Policy. We reserve the right, at our sole discretion, to change, modify, add, or remove any portion of this Privacy Policy, in whole or in part, at any time. Revised versions will be effective when it is posted. If we materially change the way we use or disclose personal information previously collected from you through our Site, we will give you notice of the revised Privacy Policy by posting the revised Privacy Policy on the Site and by revising the “last revised” date at the top of this Privacy Policy, by email, or other communication.
